Terms and Conditions of Sale
1. Seller identification
The website restelya.com and the Restelya brand are operated by a limited liability company incorporated under Swiss law, with its registered office in Geneva.

The seller's full company name, address and business identification number are set out in our legal notice. The contract of sale is concluded with that company.
2. Purpose and scope
These terms govern sales concluded on this site between the seller and any buyer acting as a consumer. Placing an order implies unreserved acceptance of them. They prevail over any other terms.
The seller may amend them; the applicable terms are those in force on the date of the order.
3. Products
The products offered are sleep and comfort accessories. They are neither medical devices nor health products, and are not intended to diagnose, treat or prevent any condition.
Photographs and descriptions are provided for guidance. Slight variations in shade or dimension do not engage the seller's liability.
4. Prices, VAT and import charges
Prices are shown in euros, inclusive of all taxes. Shipping is free, with no minimum order, to France, Belgium, Luxembourg, Switzerland and the whole of the European Union.
Items ship from warehouses located outside the European Union. Import duties and taxes, as well as the VAT of the destination country, may be collected by the carrier on delivery. These amounts remain payable by the buyer and are in addition to the price paid on this site.
The amount depends on the destination country and the value of the order. Details are on the Shipping & Returns page.
The seller may change prices at any time; products are invoiced at the rate in force when the order is recorded.
5. Orders
The sale is complete upon the order confirmation sent by email. The seller may refuse an order in the event of a prior dispute, suspected fraud or unavailability.
6. Payment
Payment is due at the time of order. Transactions are secure and the seller has no access to any banking data.
7. Delivery
Times and zones are detailed on the Shipping & Returns page. Stated times are indicative and may be extended in the event of a customs inspection.
Under European regulation, in the absence of any indication, delivery takes place no later than 30 days after conclusion of the contract. After that period the buyer may require the seller to deliver within a reasonable additional period and, failing that, terminate the contract and obtain a full refund.
Risk of loss or damage passes to the buyer on taking physical possession of the goods.
8. Right of withdrawal, return costs and diminished value
The buyer has 14 calendar days from receipt to withdraw without giving a reason and without penalty. This may be exercised in writing to contact@restelya.com or through our online withdrawal form.
Under Article 14(1) of Directive 2011/83/EU, the direct cost of returning the goods is borne by the buyer. That cost is estimated at between €10 and €20 depending on the carrier and the destination country.
By way of a derogation favourable to the buyer, for items priced under €25 the seller issues the refund without requiring the product to be returned.
Under Article 14(2) of the same Directive, the buyer may be held liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. A sum corresponding to that loss of value may then be deducted from the refund. Normal trial of the product, including over several nights, gives rise to no deduction. The seller informs the buyer in writing, with supporting evidence, before any deduction is made.
Where the goods are faulty, not as described or damaged, return costs are borne entirely by the seller and no deduction is applied.

9. Statutory guarantee and commercial guarantee
The seller is liable for defects in conformity existing at the time of delivery, under the conditions provided by applicable law. The buyer may obtain repair or replacement of the goods and, failing that, a price reduction or termination of the contract.
A commercial guarantee of 30 nights is granted on certain items. It is subject to the conditions detailed on the Shipping & Returns page: a reasoned request, a prior offer of exchange at the seller's cost, one item per household per product, and normal use of the product.
This commercial guarantee adds to the statutory guarantees without replacing them and in no way limits the 14-day right of withdrawal.
10. Personal data
Data processing is described in our Privacy Policy. The buyer has rights of access, rectification, erasure, portability and objection.
11. Intellectual property
All content on this site — text, images, trade marks — is protected. Any reproduction without written authorisation is prohibited.
12. Dispute resolution
In case of difficulty, the buyer should first contact customer service at contact@restelya.com.

These terms are governed by Swiss law, without depriving the consumer of the protection afforded by the mandatory provisions of the law of their habitual residence.
